ARTICLE 1 – PURPOSE
These General Terms and Conditions of Sale (GTCS) govern the sale of clothing, accessories and related products made on the website www.wailoa.fr.
They apply to any order placed by a consumer, within the meaning of the French Consumer Code.
ARTICLE 2 – PRICES

Prices are shown in euros, all taxes included (incl. VAT).

Handling, packaging and delivery charges are specified before the order is confirmed.

For international deliveries, customs duties and local taxes may apply. These charges are payable by the customer.

The products remain the property of Waïloa until full payment of the price.
ARTICLE 3 – ORDERS

Orders are placed exclusively online via www.wailoa.fr.

Contractual information is presented in the French language.

Waïloa reserves the right to refuse an order in the event of a dispute, a supply problem or suspected fraud.
ARTICLE 4 – ORDER CONFIRMATION
Confirming the order constitutes acceptance of these GTCS.
A summary e-mail is sent to the address provided by the customer.
ARTICLE 5 – PAYMENT

Payments are secure and can be made by bank card, PayPal or any other method offered.

Your account is debited at the time of shipment. In the event of partial delivery, only the amount of the products shipped is debited.
ARTICLE 6 – RIGHT OF WITHDRAWAL
In accordance with Articles L.221-18 et seq. of the French Consumer Code:

You have a period of 14 days from receipt to exercise your right of withdrawal, without having to give any reason.

Return costs are payable by the customer.

Products must be returned new, unworn, with their original labels and packaging.
Exceptions (Article L.221-28 of the French Consumer Code):

Personalised products or products made to order.
-
Products unsealed for hygiene reasons (e.g. masks, swimwear).

Products liable to deteriorate rapidly.
ARTICLE 7 – AVAILABILITY
Our products are offered while stocks last.
If a product is unavailable, the customer will be informed by e-mail and refunded.
ARTICLE 8 – DELIVERY

Products are shipped to the address provided when ordering.

In the event of a delay, the customer is informed and may, in accordance with Article L.216-2 of the French Consumer Code, request cancellation of the order.

Estimated delivery times are specified when ordering (some made-to-order products may require 15 working days).
ARTICLE 9 – LEGAL GUARANTEES
In accordance with the law, all products benefit from:

The legal guarantee of conformity (Articles L.217-4 to L.217-14 of the French Consumer Code).

The guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code).
In the event of non-conformity, the customer may request repair, replacement or a refund.
ARTICLE 10 – LIABILITY
Waïloa cannot be held liable in the event of:

improper use of the products,

damage resulting from misuse,

incompatibility with a particular use not mentioned,
-
disruptions related to the Internet network.
ARTICLE 11 – GOVERNING LAW AND DISPUTES
These GTCS are governed by French law.
In the event of a dispute, and after an attempt at amicable resolution, jurisdiction is granted to the competent French courts.
The consumer may also use mediation in accordance with Articles L.612-1 et seq. of the French Consumer Code.
ARTICLE 12 – INTELLECTUAL PROPERTY
All elements of the website www.wailoa.fr (text, images, logos, graphics) are protected by the French Intellectual Property Code.
Any reproduction, modification or use without authorisation is prohibited.
ARTICLE 13 – PERSONAL DATA (GDPR)

Waïloa collects and processes your personal data for order management, customer relations and service improvement.

In accordance with the GDPR (EU Regulation 2016/679), you have the right to access, rectify, object to, port and erase your data.

ARTICLE 14 – ARCHIVING / EVIDENCE
Orders and invoices are archived on a reliable and durable medium.
Waïloa's computerised records are deemed to constitute evidence of communications, orders and payments.
ARTICLE 15 – PERSONALISED PRODUCTS
Personalised products are not taken back, exchanged or refunded (except in the case of a manufacturing defect).
The customer guarantees that any visuals or texts supplied respect copyright and intellectual property rights.
